Kpebu unsure leaked tape on IGP will be considered in court

Kpebu Martin, a lawyer who works on a private basis, believes that the constitution makes it quite plain whether or not secret recordings can be used as evidence in court.

According to what he indicated, the content is typically quite important in situations involving tapes that have been released.

In reference to illegally obtained tapes, he stated that the Supreme Court has stated that the admissibility of recordings such as these for which consent has not been requested will be decided on a case-by-case basis.

He was speaking in reference to the most recent recording that had been leaked, which captured certain senior police officials and New Patriotic Party (NPP) officials plotting the removal of the Inspector General of Police (IGP), Dr. George Akuffo Dampare. His comments were made with respect to this audio.

The recording has sparked debate, with some individuals demanding a comprehensive investigation and even probable criminal punishment of the individuals whose voices could be audibly heard on the video.

Already, Parliament will investigate the veracity of the recording, the conspiracy to remove the existing IGP, and any other issue that is contained in the audio recording, and it will recommend sanctions to anyone found to be responsible in situations where it is appropriate to do so.

The Speaker of the House, Alban Bagbin, appointed a special committee with seven members, and these are some of the terms of reference for that committee.

During his appearance on TV3’s The Keypoints on Saturday, July 15, Mr. Kpebu contributed to a conversation by stating that the court will have the authority to decide whether or not the recording should be admitted into evidence.

In accordance with Article 18 of our constitution, they will evaluate not only the nature of the offence but also its severity and the surrounding circumstances.

However, he expressed confidence that the courts will evaluate this as it relates to the safety of the nation because leaked tapes identical to the most recent one have been permitted in court. He said that this makes it highly probable that the courts will consider this.

He lauded the individual who had taped the conversation and then shared it with others, stating that such behaviour is essential to the functioning of any modern democracy.

The contentious recording has become a source of concern for many people, particularly in regard to the erratic talks that were captured on it.

The voices have stated that the Inspector General of Police (IGP) needs to be replaced in order for the New Patriotic Party (NPP) to have any chance of remaining in power in 2024.

They assert that Dr. Akuffo Dampare is backing the National Democratic Congress (NDC) and that this is due to the fact that John Dramani Mahama, the NDC’s candidate for 2024, has given him a strong promise that he will continue in his position.
