The Supreme Court has overturned the re-collated parliamentary election results for Okaikwei Central, Ablekuma North, Tema Central, and Techiman South.
This important decision overturns the Electoral Commission’s (EC) re-collection and declarations for these constituencies, which had been the source of much legal and political controversy.
However, the Supreme court confirmed the legality of the re-collected results for Nsawam Adoagyiri and Ahafo Ano East, which are unaffected.
According to the court, the trial judge disregarded the NDC Parliamentary Candidates’ right to a hearing when they petitioned the High Court.
This order judgment directly contradicts the Electoral Commission’s disputed re-collation and subsequent statements for the aforementioned constituencies.
He said that, despite the quashing, the claim for mandamus remains alive and must be considered and decided by the High Court on Tuesday, December 31.
The now-quashed December 20 verdict ordered the EC to re-collate results in nine constituencies where irregularities were suspected.
The ruling came after a mandamus application was filed by New Patriotic Party (NPP) parliamentary candidates, who contended that anomalies in the tabulated results necessitated verification to ensure transparency and correctness.
The EC has subsequently complied with the ruling in seven constituencies, but the re-collection for Dome-Kwabenya and Ablekuma North is still completed.
The decision emphasizes the judiciary’s critical role in resolving electoral disputes and guaranteeing strict adherence to constitutional and procedural requirements.
