In compliance with Article 146(9) of the 1992 Constitution, President John Dramani Mahama has immediately removed Her Ladyship Justice Gertrude Araba Esaaba Sackey Torkornoo, the Chief Justice, from her position.

The judgement comes after the Committee of Inquiry, which was formed under Article 146(6) of the Constitution to look into a petition filed by Mr. Daniel Ofori, a Ghanaian citizen, demanding the Chief Justice’s dismissal, received its findings.

The Committee determined that the claims of claimed misbehaviour under Article 146(1) had been adequately proven after reviewing the petition, copious amounts of material, and witness statements. Therefore, it is advised that she be removed from her position.

The Constitution’s Article 146(9) requires the President to follow the Committee’s conclusions and recommendations.

Felix Kwakye Ofosu, the Minister for Government Communications and the Spokesperson to the President, announced the decision in a statement on Monday, September 1, 2025, stating that the Chief Justice’s dismissal was legal.

He reassured the public that the petitioner and the Chief Justice were given every chance to submit their positions before the Committee, and that the procedure was carried out strictly in accordance with constitutional standards
